What is the Disability Marker?

In softgarden, there is the option to mark applicants with a recognized disability or equivalent status. This marker helps companies comply with legal requirements according to § 165 SGB IX and ensures a fair, discrimination-free treatment in the application process.

How is the Marker Set?

The marker is set manually in the applicant profile.

The corresponding entry must always be manually set:

  • Open the application.

  • Switch to the "Application" tab → "Personal Data & Application Details."

  • In the "Disability" field, you can set the selection to "Yes" via the dropdown menu.

After saving, a small blue symbol appears under the applicant's picture, indicating the marker as disabled – visible to all users in the job team.

Note: Automatic adoption from application questions or documents is not possible.

Where is the Marker Displayed?

The marker is discreet but clearly recognizable:

  • In the applicant profile below the applicant's picture (blue symbol)

  • In the applicant list through the "Disability" filter

  • Not in reports or exports unless explicitly enabled

Who Sees the Marker?

The visibility of the disability marker is linked to the job assignment. Anyone assigned to the respective job – including the recruiting team – has insight into the marker.

This means:

  • Recruiters with job assignment

  • HR personnel assigned to the job

  • If applicable, members of the disability representation (if involved)

Departments or hiring managers not assigned to the job do not have access to the marker.

This regulation ensures that the information is only visible in the relevant context – aiming to maintain both transparency and data protection.

Why is the Marker Important?

The marker helps companies:

  • implement the legally required preferential consideration of applicants with disabilities

  • involve the disability representation early

  • strengthen internal processes for equal opportunities and inclusion

Data Protection and Consent

Indicating a disability is voluntary. Applicants must actively agree to have this information processed. softgarden ensures that the data is stored in compliance with GDPR and made accessible only to authorized individuals.

Conclusion

The disability marker in softgarden is an important tool to meet legal requirements and enable fair and inclusive applicant selection. Please note that the marker is not automatically adopted from application questions and must therefore be maintained manually.
